(AKRON, Ohio)—Ohio Attorney General Mike DeWine today announced a lawsuit against Phoenix Indoor Auto Sales for failing to deliver motor vehicle titles according to Ohio law.
The lawsuit seeks reimbursement for consumers and for the Title Defect Rescission Fund. It also accuses Phoenix Indoor Auto Sales and agent Elizabeth Severy of violating Ohio’s Consumer Sales Practices Act and Certificate of Motor Vehicle Title Act by failing to deliver titles to purchasers and failing to honor warranties.
“We found a pattern of violations in this case,” Attorney General DeWine said. “Those responsible must be held accountable.”
Phoenix Indoor Auto Sales last operated at 903 E. Tallmadge Avenue in Akron, according to the lawsuit. In the past year, the Ohio Attorney General’s Office has received more than 100 complaints against the dealership. Most involved title problems.
The Attorney General’s Office helped resolve consumer complaints, in some cases by making payments from the Title Defect Rescission Fund, a program that helps reimburse consumers when a dealership fails to provide a title as required by law. (The fund includes payments and fees from motor vehicle dealers.) To date, more than $160,000 has been paid from the Title Defect Rescission Fund to assist Phoenix Indoor Auto Sales customers.
