Attorney General DeWine Seeks Reimbursement from Dealership Accused of Failing to Deliver Titles

3/18/2015

(WILMINGTON, Ohio)—Ohio Attorney General Mike DeWine today announced that his office has filed a lawsuit against a Clinton County used car dealership accused of failing to deliver motor vehicle titles as required by law.

The lawsuit accuses MC Auto and its owner Michael Crow of violating Ohio consumer laws. It also seeks reimbursement to the Title Defect Rescission Fund, a state program that helps car buyers who fail to receive valid titles to vehicles they purchase from a dealership.

“In order to drive legally in Ohio, you need a valid vehicle title. Most dealerships consistently deliver titles to their customers as required, but we found that this dealership did not comply with the law,” Attorney General DeWine said. “We are seeking reimbursement to the Title Defect Rescission Fund and an end to the violations.”

MC Auto last operated at 11 E. Washington Street in Sabina. It is currently closed.

Dozens of consumers filed complaints against MC Auto saying that the dealership failed to provide titles for the vehicles they purchased.

Attorney General DeWine’s office helped consumers who filed complaints, in some cases using payments from the Title Defect Rescission Fund. Payments from the fund totaled nearly $14,000.

The Attorney General’s lawsuit, filed in the Clinton County Common Pleas Court, seeks reimbursement to the fund, consumer restitution, civil penalties, and an end to further violations. It also accuses MC Auto and Michael Crow of violating the Ohio Consumer Sales Practices Act and Certificate of Motor Vehicle Title Act.

Consumers who have title problems after purchasing a motor vehicle or who have other problems with a consumer transaction should contact the Ohio Attorney General’s Office at 800-282-0515 or www.OhioAttorneyGeneral.gov.
