Sandusky County Sheriff Indicted on 43 Counts

(FREMONT, Ohio)—A Sandusky County Grand Jury has issued indictments against Sandusky County Sheriff Kyle Overmyer following an investigation by the Ohio Bureau of Criminal Investigation (BCI).

Overmyer, 42 years-old, was indicted on 43 counts, including 38 felony counts:

  • 12 counts of Tampering with Records, felonies of the third degree
  • 12 counts of Deception to Obtain a Dangerous Drug, felonies of the fourth degree
  • Three counts of Deception to Obtain a Dangerous Drug, felonies of the fifth degree
  • Six counts of Theft in Office, felonies of the fourth degree
  • Four counts of Theft, felonies of the fourth degree
  • One count of Theft, a felony of the fifth degree
  • Five counts of Filing False Financial Disclosure Reports, misdemeanors of the first degree
BCI was asked to conduct an investigation into Overmyer by Sandusky County Prosecutor Thomas L. Stierwalt and opened an investigation in September 2015. Stierwalt requested the investigation after local police chiefs in Sandusky County expressed concerns regarding alleged unusual behavior by Overmyer in prescription drug disposal drop box collections. The scope of the investigation quickly expanded into other allegations of wrongdoing.

The charges issued today allege that Overmyer improperly used, and tampered with records concerning, his office’s Furtherance of Justice (FOJ) funds. The charges also allege that Overmyer deceived physicians and pharmacists in order to obtain prescription pain medication. The Theft charges relate to allegations that Overmyer improperly took medications from area prescription drug disposal drop boxes.

Delaware County Prosecutor Carol Hamilton O’Brien is serving as special prosecutor in this case. She was appointed special prosecutor in February at the request of Stierwalt.

Overmyer is expected to be arraigned tomorrow, August 24th, before Visiting Judge Patricia A. Cosgrove.
