(DAYTON, Ohio)—Ohio Attorney General Mike DeWine today announced a lawsuit against a Dayton used car seller accused of failing to deliver motor vehicle titles to consumers.
The lawsuit seeks reimbursement from Ashley Alexander, doing business as Alexanders Auto Sales, after nearly $11,000 from the Title Defect Rescission Fund was used to help consumers who filed complaints against the dealer.
“When you buy a car, you expect to receive the title. In this case, that didn’t always happen,” Attorney General DeWine said. “Our goal is to protect consumers and to bring this seller into compliance with the state’s consumer protection laws.”
According to the lawsuit, Alexanders Auto Sales operates in Dayton at 5001 N. Dixie Drive and at 5115 N. Dixie Drive. Several consumers have filed complaints against the dealership, with most citing title problems.
The Attorney General’s lawsuit, filed in the Montgomery County Common Pleas Court, accuses Alexander of violating Ohio’s Consumer Sales Practices Act by failing to obtain or deliver titles to purchasers as required by law and failing to register a business name with the Ohio Secretary of State.
In the lawsuit, the Attorney General seeks an end to any violations of the law, reimbursement for affected consumers, civil penalties, and reimbursement to the Title Defect Rescission Fund.
The Title Defect Rescission Fund, by law, is administered by the Ohio Attorney General’s Office to help buyers who experience certain title problems after purchasing a motor vehicle from a dealership. The fund includes payments and fees from motor vehicle dealers.
