(RAVENNA, Ohio)—Ohio Attorney General Mike DeWine today announced a lawsuit against Round House Racing LLC, the organizer of Foam Fest 2014, a mud obstacle-course event that was canceled days before it was scheduled to be held in Garrettsville.
“This business took advance payment from consumers and then abruptly canceled its event without providing refunds,” Attorney General DeWine said. “We are seeking restitution for consumers and an injunction to stop further violations of Ohio’s consumer protection laws.”
Round House Racing, which is based in Spanish Fork, Utah, advertised Foam Fest 2014 as a fun social event involving foam machines and a mud obstacle course, where athletes of all sizes and experience could participate, either individually or organized in a team.
Participants paid about $90 each and were told that some of the proceeds would benefit A Child’s Hope Foundation to help orphans.
The event was supposed to be held on July 19 in Garrettsville at Southington Off-Road, near Hiram. On July 17, consumers received an email stating that the event was being canceled. The email offered free registration at another group’s events, but Round House Racing did not offer to provide refunds to consumers who had paid for the July 19 event.
Following the cancellation, the Ohio Attorney General’s Office received more than 60 complaints, though additional consumers likely have been affected.
Filed in the Portage County Court of Common Pleas, the Attorney General’s lawsuit charges Round House Racing with violating Ohio’s Consumer Sales Practices Act. Specific counts include failing to deliver the promised event and failing to disclose refund limitations at the time money was collected. In the lawsuit, the Attorney General seeks consumer restitution, injunctive relief, and civil penalties.
