Amicus Brief Sent to U.S. Supreme Court

10/30/2013

(COLUMBUS, Ohio)— Ohio Attorney General Mike DeWine has sent an amicus brief to the U.S. Supreme Court that urges the Supreme Court to consider the Ninth Circuit’s decision in the case of Horne v. Isaacson.

Ohio and Montana are lead amici, with Alabama, Colorado, Georgia, Idaho, Indiana, Kansas, Michigan, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Texas, and Utah joining the brief.

The states advocate that the Supreme Court should take the case in order to make clear that states can pass reasonable limits on elective abortions after 20 weeks gestation in response to emerging scientific evidence that the unborn child can feel pain at that time onward.
