Attorney General DeWine Announces Recovery of $2.14 Million for Ohio in ODOT Construction Case

10/29/2012

(COLUMBUS, Ohio) - Attorney General Mike DeWine announced the recovery of $2.14 million for the faulty metal roofing used in the construction of the Ohio Department of Transportation's District Headquarters in Tuscarawas County. The jury verdict on Oct. 23 is against Butler Manufacturing, of Kansas City, Mo., the supplier of the roofing materials.

"This is a substantial recovery for the state," said Attorney General DeWine. "Just as we work to protect consumers from harm, we are also working hard to make sure state agencies and taxpayers are treated fairly and responsibly."

Soon after the installation of the 167,000 square foot metal roof on the district headquarters in New Philadelphia, extensive rust and corrosion began. The Attorney General's Office Construction Litigation Group, representing the state, submitted scientific evidence that the metal used for the building's roof had not been properly rustproofed during the manufacturing process. ODOT has repaired the roof.

The $2.14 million represents the cost of removing the defective roof and installing a new one and was the full amount requested by the state. Additional prior settlements with contractors who installed the roof bring the total recovery to $2.64 million.
