Attorney General DeWine Sues Cleveland-Area Foreclosure Rescue Company

5/14/2012

(CLEVELAND, Ohio) – Attorney General Mike DeWine today announced a lawsuit against K&R Marketing, LLC, doing business as Fix My Mortgage Problem. The lawsuit charges the business and its owner with multiple violations of Ohio’s consumer laws, including failure to deliver.

“This company was misleading consumers,” Attorney General DeWine said. “Consumers said they paid fees for loan modification help, but never received assistance. Homeowners who are trying to prevent foreclosure on their homes should avoid businesses that charge up-front fees for their services.”

K&R Marketing LLC is located at 192B E Wallings Road, Broadview Heights, Ohio. All of the complaints the Ohio Attorney General’s Office has received are from out-of-state consumers.

Christopher Bray, the owner of K&R Marketing, told consumers that he would work with their mortgage companies to modify their loans for up-front fees between $500 and $1,000. After accepting the down payment, Bray did little to aid consumers and did not provide refunds.

The Attorney General’s lawsuit charges K&R Marketing and Bray with multiple violations of the Consumer Sales Practices Act, including failure to deliver and failure to provide refunds. It also charges the business and its owner with violating the Debt Adjusters Act by offering loan modifications and charging fees greater than allowed by law. The lawsuit seeks a permanent injunction, consumer restitution, and civil penalties.

DeWine offers consumers the following advice:

  • Do not pay up-front fees for help in avoiding foreclosure or obtaining mortgage relief. By law, companies are prohibited from charging and accepting fees for mortgage assistance relief services until consumers receive and accept a loan modification offer from their lenders.
  • Research a business before giving it any money or information. Check to see if consumers have filed complaints with the Ohio Attorney General’s Office and check a company’s reputation with the Better Business Bureau. Don’t use a loan modification business that charges upfront fees.
  • Contact Save the Dream Ohio. Call 888-404-4674 or visit www.savethedream.ohio.gov for free foreclosure assistance.

Consumers who believe they have been treated unfairly should file a complaint with the Ohio Attorney General’s Office at www.OhioAttorneyGeneral.gov or by calling 800-282-0515.
