Attorney General DeWine, Ohio EPA Director Issue Statements on Court Order in Pineview Safe Drinking Water Case

(DAYTON, Ohio)—Ohio Attorney General Mike DeWine and Ohio Environmental Protection Agency Director Craig W. Butler issued the following statements on the temporary restraining order issued today in the Montgomery County Common Pleas Court against Pineview Pines Estates, a mobile home park the state has accused of multiple drinking water violations.

“We are pleased that the Court has agreed to grant this immediate relief, and we will continue to pursue the case to correct the problems at Pineview to ensure that residents have clean, safe, and reliable drinking water,” Attorney General DeWine said.

“We appreciate Judge O’Connell’s granting of the temporary restraining order this morning,” Ohio EPA Director Craig W. Butler said. “It assures that Pineview will keep bottled water on hand to get residents through any future service disruptions and that a qualified expert will assess the water system’s problems and needs as we move toward a long-term solution.”

Today’s order requires Pineview Pines Estates and its owner, Timothy Dearwester, to immediately provide Pineview residents with bottled water and make four gallons of bottled water per resident available as long as service disruption continues. It also requires Pineview and Dearwester to maintain a back-up supply of water for residents, to hire a professional engineer to evaluate and correct structural deficiencies in the Pineview water system, and to provide viable contact information to the Ohio EPA for any emergency.

Yesterday, the Attorney General, on behalf of the Ohio EPA, filed a complaint and a motion for a temporary restraining order against Pineview Pines Estates and Dearwester for numerous violations of Ohio’s safe drinking water laws, which left residents without drinking water on several occasions.

A preliminary injunction hearing on the case is set for Feb. 5.
