(CINCINNATI) – Ohio Attorney General Mike DeWine today announced a lawsuit against William Adair III, doing business as Superior Construction, for multiple violations of the Consumer Sales Practices Act and the Home Solicitation Sales Act.
Superior Construction is a home improvement business. Its principal place of business is 14 Apple Lane, Milford, Ohio.
“The business name includes the word superior but consumers who filed complaints with my office described shoddy and incomplete work,” said Attorney General DeWine. “Consumers who buy a product or service have to get what they pay for.”
In complaints filed with the Ohio Attorney General’s Office, consumers said the business started work but either did not return to complete the work or the work was shoddy. For example, a Cincinnati consumer said he paid $17,500 for a new kitchen. After doing minimal work - installing a new floor and gutting the kitchen - the business did not return to finish the work. A Milford consumer said that after she paid $1,830 to have her bathroom remodeled, she needed to hire another contractor to fix Superior Construction’s shoddy work.
The Attorney General’s lawsuit charges William Adair, doing business as Superior Construction, with multiple violations of the Consumer Sales Practices Act, including failure to deliver, performing shoddy work, falsely representing the quality of a product, and with violating the Home Solicitation Sales Act by failing to give consumers proper notice of their three-day right to cancel. The lawsuit seeks injunctive relief, consumer restitution, and civil penalties.
Attorney General DeWine encourages consumers to research home improvement businesses with the Ohio Attorney General’s Office and Better Business Bureau before making any payments. Consumers also should ask for written estimates from several businesses before making a final selection, and they should get receipts for any deposits they make.
