(MARION, Ohio) – Ohio Attorney General Mike DeWine and the Ohio Environmental Protection Agency (Ohio EPA) today announced that Marion County Judge James Slagle has granted the Attorney General’s request for a preliminary injunction to order the proper removal of asbestos-containing materials at the former industrial site 333 Joseph Street in Marion.
“It’s very important for asbestos to be managed and removed properly,” Attorney General DeWine said. “We are pleased with the Judge’s decision because of the proximity of this asbestos to children and other area residents.”
In July 2013, the Attorney General’s Office, representing the Ohio EPA, filed a lawsuit against the owners of 333 Joseph Street and a contractor involved with the demolition of a large number of buildings at the site for violations of Ohio’s environmental and nuisance laws. Counts included failure to properly dispose asbestos-containing material and failure to comply with Ohio EPA orders.
Today’s order requires defendants 333 Joseph LLC, Stanley Rosenfeld, and Eric Keith to properly remove all asbestos-containing materials at 333 Joseph Street by March 1, 2014 and to prevent the public from accessing the site during the removal process.
